§ 5.20.010. Definitions.

As used in this chapter, the following terms are defined:

"Employee" means a person who performs any service on the premises of a medical marijuana facility on a full-time, part-time or contract basis, whether or not the person is denominated an employee, independent contractor, agent or otherwise, and whether or not such person is paid a salary, wage or other compensation by the operator of such business. Employee does not include exclusively on the premises for repair or maintenance of the premises or equipment on the premises, or for the delivery of goods to the premises.

"Licensee" means a person in whose name a license to operate a medical marijuana-related facility has been issued, as well as the individual listed as an applicant on the application for a license; and in the case of an employee, a person in whose name a license has been issued authorizing employment in a medical marijuana facility.

"Medical marijuana" means of all parts of the genus cannabis whether growing or not, and the seed of such plants that may be administered to treat or alleviate a qualifying patient's debilitating medical condition.

"Medical marijuana cultivation" means the process by which a person grows a marijuana plant. A facility shall mean a building, structure or premises used for the cultivation or storage of medical marijuana that is physically separate and offsite from a medical marijuana dispensary or a medical marijuana manufacturing facility.

"Medical marijuana dispensary" means a nonprofit entity defined in A.R.S. 36-2801(11), that sells, distributes, transmits, gives, dispenses, or otherwise provides medical marijuana to qualifying patients.

"Medical marijuana-related facility" includes any building, structure or premises used for the cultivation, storage, or dispersal of medical marijuana. A medical marijuana facility shall include a medical marijuana cultivation facility, a medical marijuana dispensary and a medical marijuana manufacturing facility.

"Medical marijuana manufacturing facility" means a facility that produces medical marijuana (cannabis) by means of cooking, blending, or incorporation into consumable/edible goods.

"Medical marijuana qualifying patient" means a person who has been diagnosed by a physician as having a debilitating medical condition as defined by A.R.S. 36-2801.13.

"Person" means an individual, proprietorship, corporation, association or other legal entity.

"Specified criminal activity" means any of the offenses listed in A.R.S. Title 36, Chapter 28.1 as an "excluded felony offense."
