§ 2.40.010. Appointment—Term—Removal from office.

  • A.

    The presiding officer of the Eagar Municipal Court shall be the town magistrate who shall be selected and appointed by the council.

    B.

    The council shall set the minimum qualifications for the position. The town magistrate is required to be professional, fair and impartial in presiding over many types of cases, such as misdemeanors, civil traffic, protective orders, and town ordinance violations in a variety of settings, including initial appearances, arraignments, civil traffic hearings, jury trials and issuance of search warrants. The town magistrate shall be honest, demonstrating character qualities of the highest caliber. The town magistrate represents the town as its judicial officer and shall be free of any improprieties, conflicts of interest or appearances of conflicts of interest.

    C.

    A magistrate serves at the pleasure of the council for a minimum term of two years with the beginning and ending of the term specified at the time of appointment. Reappointment may be authorized. During this term a magistrate may be removed only for cause.
