§ 17.04.120. Exceptions.

  • When a subdivider can show that the application of these regulations are unreasonable due to items such as topography or other unique circumstances, the subdivider may request an exception to the requirements of this title. Financial hardship will not qualify for an exception. The request must be made in writing describing the item(s) that the exception is being requested for. The subdivider must present the request for the exception to the town council prior to the final plat being approved by the planning and zoning commission. The reasons for exception(s) which are particular to the subdivision shall be recorded in the minutes of the council, and therefore shall be individual in nature and not set a "precedence" for nonadherence to these regulations.
